Do NRIs Need A Tax Clearance Certificate Before Leaving India?

The confusion resurfaced after recent updates to India’s income-tax law triggered viral claims that all outbound travellers, including NRIs, must obtain tax clearance before departure. The Central Board of Direct Taxes has clarified that this is not a blanket rule and remains limited to specific risk-based situations.

CBDT says the certificate can be asked for only when an income-tax authority records reasons and gets approval from the Principal Chief Commissioner or Chief Commissioner. As per the government’s clarification, this applies mainly in two cases: serious financial irregularities or pending tax dues exceeding Rs 10 lakh without a stay.
