Labour Codes Face Big Test In India’s Vast Outsourced Workforce

Persistent Gaps Behind Legal Reforms

The labour codes aim to simplify and modernise wage, social security, safety and industrial relations laws, but implementation is uneven, especially in multi-layered vendor and subcontractor chains. Outsourced workforces in logistics, manufacturing, facility management, e-commerce, security, and services often sit in a grey zone where principal employers push responsibility down the chain and inspection capacity is limited.

Why Outsourced Networks Are Hard To Police

Complex supply chains, multiple intermediaries, and informal hiring practices make it difficult to ensure minimum wages, social security contributions, working hours and overtime norms are actually followed. Many workers lack written contracts, payslips or digital records, weakening their ability to file complaints or prove violations and leaving enforcement dependent on sporadic inspections.

What Stronger Execution Should Look Like

Stricter joint liability for principal employers, mandatory digital wage and PF/ESI records, and tech-enabled inspections can significantly tighten compliance. Public disclosure of compliance metrics, worker helplines, and easier grievance redressal would also help bring India’s outsourced, gig and temporary workers meaningfully under the labour code framework.
