Indian courts are quietly changing how India fights online piracy, especially around movies, live sports and OTT shows. Instead of only reacting after a leak or illegal stream goes viral, judges are increasingly stepping in before release with wider, smarter orders. The goal is simple: make it harder and riskier for pirate sites to operate in real time, without dragging rights holders back to court for every single URL.

How We Moved Beyond Whack-A-Mole

Earlier, the pattern was painfully familiar: a big film or match would release, pirated copies would flood torrent sites and shady streams, and then complaints and takedown notices would begin. By the time some links were blocked, new ones were already up. It was digital whack‑a‑mole, and pirates usually stayed one step ahead.

Now, courts increasingly grant pre-emptive injunctions before major releases, especially against so‑called “rogue websites” that repeatedly host or link to illegal content. These orders don’t just name a single URL; they often cover entire domains and allow fresh lists of pirate links to be plugged into the order later, without starting from scratch every time.

Dynamic Blocking And New Duties For Intermediaries

One of the biggest shifts has been the rise of “dynamic” blocking orders. Instead of chasing individual links, these orders let rights holders and service providers block new mirrors, domains and IP addresses carrying the same infringing content as they appear. That way, pirates can’t simply register “site123-new.com” and carry on as usual.

With this, courts are also pushing more responsibility onto intermediaries especially internet providers and sometimes hosting or platform services. They are expected to respond quickly to court-backed blocking requests, keep blocks effective, and coordinate better with rights owners, while still staying within the broader framework of safe harbour and user rights.
