India Rejects Arbitration Award On Indus Waters Treaty

India’s Ministry of External Affairs (MEA) issued a strong statement dismissing the May 15, 2026 award by the Court of Arbitration (CoA). The ruling concerned pondage limits at Indian hydroelectric projects, but India maintained that the CoA has no legitimacy and disputes must be addressed through a Neutral Expert mechanism.

The government emphasized that the Indus Waters Treaty was suspended in April 2025 following the Pahalgam terror attack. India insists the treaty will remain in abeyance until Pakistan credibly addresses cross-border terrorism, making arbitration awards irrelevant during this period.  

Background of the dispute  

Pakistan had sought arbitration over India’s Kishenganga and Ratle projects, leading to the CoA’s formation in 2023. India refused to participate, arguing that technical design issues fall under the Neutral Expert framework. The CoA’s earlier rulings favored Pakistan, restricting India’s project flexibility.
