Kyiv Strikes Gold: Ukraine’s Parliament Greenlights Thrilling U.S. Minerals Pact

Ukraine's parliament has officially approved a high-stakes mineral agreement with the United States, a critical turning point in the nations' economic and strategic partnership as Russia's war rages on. These are the top points:

Joint Investment Fund: The agreement establishes the American-Ukrainian Reconstruction Investment Fund, to which both countries will contribute equally. Both mining and energy project revenues will feed into the fund, financing Ukraine's reconstruction and economic resilience.

Preferential U.S. Access, Ukrainian Control: The U.S. has preferential rights to invest in and extract Ukraine's bountiful natural resources-rare earths, oil, gas, gold, and copper-but Ukraine maintains final control over what and where extraction takes place, and ownership of its subsoil is held by the Ukrainian state.

No Repayment for Previous Assistance: In contrast to previous versions, the deal does not obligate Ukraine to pay back the U.S. for previous military and economic aid-a major victory for Kyiv after contentious talks.

Military Assistance Credited Towards Investment: Subsequent U.S. military assistance can be considered as part of America's investment in the combined fund, potentially simplifying the delivery of assistance and reconstruction.

Security Guarantees Missing: In spite of Kyiv's insistence, the agreement does not contain direct U.S. security guarantees, although it makes strong language in support of Ukraine's sovereignty and names Russia as the aggressor.

Balanced Management: The fund will be managed on a 50-50 basis, with decisions by consensus, to ensure that neither side has a majority.

EU Accession Clause: If Ukraine becomes a member of the EU, the agreement will be renegotiated to be compatible with EU obligations.
