Equal Heirs, Equal Shares: Sons And Daughters’ Rights In Father’s Property Explained

Property division in India is governed by the Hindu Succession Act, 1956, and its landmark 2005 amendment, which granted daughters equal coparcenary rights. This means daughters now enjoy the same rights as sons in ancestral property. However, the rules differ when it comes to self-acquired property and property owned by siblings.

Division Of Father’s Property

If the father dies without a will (intestate), his property—whether ancestral or self-acquired—is divided equally among all legal heirs, including sons and daughters. Married daughters have the same rights as unmarried daughters. If the father leaves a valid will, the distribution follows his wishes.

Sister’s Claim On Brother’s Property

A sister cannot claim her brother’s self-acquired property during his lifetime. After his death, if he dies intestate, the property is divided among his legal heirs (wife, children, and parents). A sister does not automatically inherit unless specified in a will. However, if the brother inherited property from the father, the sister can claim her rightful share in that ancestral property.
