The United States Copyright Office (USCO) released Part 2 of its Artificial Intelligence and Copyright Report on January 29, 2025, clarifying the extent to which AI-generated works can be copyrighted. The report reaffirms that human authorship remains a basic prerequisite to copyrightability. AI-generated content, on its own, isn't copyright eligible.
However, works that use AI-generated content may be eligible for copyright where there is a sufficient creative human contribution. These include where AI is used as a tool to enhance the work of a human, or where a human person makes significant changes or arrangements to AI works. The USCO will examine copyright claims on a case-by-case basis and will turn to the degree of human control and creative contribution to the final product.
