Supreme Court Upholds Minor’s Right To End Pregnancy, Rejects AIIMS Plea

In a landmark judgment, the Supreme Court reiterated that unwanted pregnancies cannot be thrust upon minors, especially in cases of sexual assault. The bench, led by Chief Justice Surya Kant, underscored that the choice must rest with the survivor and her parents, while AIIMS should provide medical guidance without overriding autonomy.  

Court’s Stand On Autonomy  

The Court stressed that reproductive rights are fundamental and must prioritize the survivor’s well-being over institutional concerns. It noted that forcing a minor into motherhood would cause lifelong trauma, humiliation, and health risks, and reaffirmed that the law must evolve to protect rape survivors beyond the 20-week limit.  

AIIMS’ Concerns  

AIIMS argued that termination at 30 weeks could lead to severe complications for the minor and deformities in the foetus. The institute suggested adoption as an alternative. However, the Court dismissed the plea, stating that medical institutions cannot override the constitutional rights of individuals.
