Landowners Win Big! Supreme Court Says No to Endless Land Hold-Up

In a historic verdict, the Supreme Court of India has upheld the constitutional right to property, ruling that landowners cannot be kept away from their land forever. The bench headed by Justices J.B. Pardiwala and K.V. Viswanathan held that although the right over property is not a fundamental right anymore, it is a vital human and constitutional right under Article 300-A. The Court emphasized proper compensation during the acquisition of land, and unacceptable delays in payment can invite reconsideration of the valuation of the land. The judgment serves an important precedent to safeguard property rights and give equitable treatment to owners of land during acquisition proceedings.
