Delhi HC Says ‘Bon Appétit’—Nilkamal JV Cleared to Market Stella

In a significant legal ruling for India's consumer durables sector, the Delhi High Court has allowed Cambro-Nilkamal, a joint venture of Nilkamal Ltd, to sell induction cooktops under the brand Stella. The ruling overturns an interim injunction passed in 2024 that had banned the JV from selling the Stella trademark.
 
Justice Amit Bansal mentioned Cambro-Nilkamal's earlier usage of the Stella marks since 2013, importing goods from Stella Industrial Co Ltd, a Chinese entity. The court identified that Cambro-Nilkamal and plaintiff Products and Ideas (India) were importing original products from Stella Industrial and selling them with full authorization.
 
The ruling makes it amply clear that authorized resellers of trademark goods cannot be stopped from selling such goods in India, provided they are original and imported directly from the trademark owner.
