The untimely death of billionaire businessman Sunjay Kapur has triggered widespread guesswork on the fate of his Rs 10,300 crore legacy, particularly about his children with actress Karisma Kapoor—Samaira (20) and Kiaan (14). Indian succession law, the Hindu Succession Act, provides for all biological children of the deceased, whether married or unmarried at the time of death. But the ultimate partition is subject to whether the deceased had executed a valid will.

Key Highlights:

•  Kapur's estate will be shared by his legitimate heirs: his current wife Priya Sachdev, son Azarias, and his children with Karisma Kapoor.

•  As part of their amicably agreed-upon divorce, Samaira and Kiaan already received bonds worth Rs 14 crore each and a monthly allowance of Rs 10 lakh, while Karisma received a house in Mumbai.

•  If there is no will, the property will pass on equally to all the legal heirs, such as Samaira and Kiaan.

•  If there is a will, its terms can make particular gifts and may even modify the default statutory scheme.

•  No aspect of Sona Comstar's business operations will go to the children; management can be transferred to Kapur's sisters or stay with the existing board.

Prospect: Even though Samaira and Kiaan are financially well taken care of by past settlements, their portion of the Rs 10,000 crore inheritance depends on Sunjay Kapur's will, if he has made one, and its conditions. In the absence of one, Indian law makes them rightful heirs along with his other living wife and youngest son.
