SCDRC (State Consumer Disputes Redressal Commission) Delivers Blow to Insurance Firm in Key Ruling

The State Consumer Disputes Redressal Commission (SCDRC) has supported an order against an insurance firm, affirming consumer rights in claim settlement disputes. In recent Indian cases, SCDRCs have time and again rejected insurance companies' appeals and ordered compensation to the policyholders, highlighting the significance of timely and equitable claim settlement.
 
Key Highlights:
  • Delhi SCDRC rejected an appeal by National Insurance Co. Ltd. on grounds of delay of 54 days, holding that the insurer has not given a valid reason for the delay. The commission reminded that condonation of delay is not a right and has to be justified with good reasons.
  • In Kerala, SCDRC directed National Insurance Company Ltd. to compensate Rs 3.5 lakh to an owner of a car stolen, confirming the District Commission's ruling. The insurer's contention-that the complainant had sold the vehicle and hence did not have insurable interest-was negated, since the registration was still in the name of the complainant and the sale was not completed.
  • These decisions underpin the commitment of the SCDRC in safeguarding consumers against unwarranted delays and technical denials by insurance businesses.
