The Supreme Court has held that promotion is neither a natural nor automatic right of government employees. In its May 2025 judgment, the Court held that employees do not have a natural right to a promotion, but they are entitled to be considered for promotion if they are qualified and not disqualified. The judgment was given in a case where a Tamil Nadu police constable was not promoted due to a disciplinary punishment already suspended. The Court emphasized that the authorities must ensure that fair consideration is provided to all deserving candidates, and refusal on no basis other than a punishment already suspended is against the right to be considered. This judgment reaffirms that promotion is governed by service rules and merit, not by right, and that only merit and due process can ensure progress.
