Apple Says India’s Competition Body Overstepping Powers In Intensifying Antitrust Dispute

The confrontation between Apple and India’s competition watchdog has intensified, with the U.S. tech giant resisting demands to submit financial details. The dispute centers on whether Apple abused its dominance in the iPhone app ecosystem, a case that could carry penalties of up to $38 billion. 

Apple’s Position

Apple insists that the CCI is exceeding its powers by pushing for financial disclosures while the Delhi High Court reviews the legality of India’s penalty framework. In its April 24 court filing, Apple argued that the regulator’s decision to schedule a final hearing represents an attempt to “usurp the Hon’ble Court’s authority.” 

CCI’s Stand

The CCI has been investigating Apple since 2021 after complaints from app developers and organizations, including Match Group and Indian startups. In 2024, investigators concluded that Apple’s mandatory in-app purchase system amounted to abuse of dominance. The regulator has repeatedly asked Apple for financial data to calculate penalties but says the company has withheld information since October 2024. 

Market Context

Apple denies wrongdoing, arguing it is not dominant in India, where iPhones hold only about 9% market share, compared to Android’s overwhelming majority. However, India is a key growth market for Apple, with exports of iPhones recently crossing ₹2 trillion, making them the country’s largest branded export.
